These Terms of Service (“Terms”) govern your use of websites operated by ABC Events, Inc. and Peake Events, Inc. (“we,” “us,” or “our”), including purchasing tickets, registering for events, volunteering, or participating in any of our activities. By accessing our websites or attending our events, you agree to these Terms.

If you do not agree, please do not use our websites or purchase tickets.

1. Ticket Sales & Refund Policy

All ticket sales are final.

Tickets are non-refundable, non-transferable, and not redeemable for credit, except where required by law.

Weather Policy

All events are rain or shine, unless otherwise communicated by us.

Event Cancellation

We reserve the right to cancel, postpone, or modify an event at our sole discretion due to:

Acts of God
Severe weather
Natural disasters
Public safety concerns
Government mandates or restrictions
Venue issues
Situations outside our control

If an event is canceled for reasons listed above, refunds may be considered but are not guaranteed. Any refund or credit policy will be announced within 48 hours of an event cancellation.

2. Assumption of Risk

By attending our events, you understand and accept that:

Outdoor events involve inherent risks (weather, uneven terrain, crowds, heat, etc.).
Participation in activities (sports, contests, tastings, demos, etc.) carries physical risk.
You voluntarily assume all risks associated with attendance and participation.

You agree that ABC Events, Inc. and Peake Events, Inc. are not responsible for injury, illness, property damage, or loss.

3. Conduct & Behavior

We expect all guests, volunteers, vendors, and staff to behave respectfully.

We reserve the right to deny entry or remove anyone for:

Disorderly, unsafe, or aggressive behavior
Harassment or threats
Intoxication
Violation of event rules
Violation of local laws

No refunds will be provided if removal occurs.

4. Photography & Media Release

By attending our events, you consent to being photographed, filmed, or recorded.
We may use these images for promotional, marketing, or documentation purposes without compensation.

If you do not wish to be photographed, you must avoid areas where cameras are in use.

5. Vendor & Sponsor Participation

Vendors, sponsors, and contractors must comply with:

Event rules
Local/state regulations
Health department requirements
Payment and contract terms

Failure to comply may result in removal without refund.

6. Intellectual Property

All content on our websites—including logos, images, branding, and written material—is owned by ABC Events, Inc. or Peake Events, Inc. and may not be used without permission.

7. Third-Party Services

We may use third-party partners for:

Ticketing
Payment processing
Email marketing
Analytics
Advertising

We are not responsible for errors, downtime, or data practices from third-party services.

8. Privacy

9. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for personal injury, illness, property damage, lost items, or incidental damages.
Your sole remedy for dissatisfaction is to stop using the website or not attend the event.
We do not guarantee uninterrupted or error-free website operation.

Some jurisdictions do not allow certain liability limitations, so some of the above may not apply.

10. Indemnification

You agree to indemnify and hold harmless ABC Events, Inc., Peake Events, Inc., their owners, staff, volunteers, and partners from any claims arising out of your:

Attendance
Website use
Rule violations
Misconduct

11. Changes to These Terms

We may update these Terms from time to time.
Updates take effect immediately upon posting.

Continued use of our websites or attendance at events constitutes acceptance of the updated Terms.
